This Website is designed to provide a convenient and informative retail experience for you to obtain information in relation to the Ramsay Pharmacy Network and purchase products. Orders for products through the Website for delivery will be submitted to Judevie Pty Ltd for fulfillment.

The Privacy Policy and these terms and conditions govern your use of the Website and Services.   

1. Definitions

Privacy Policy means the Ramsay Pharmacy Privacy Policy, which can be accessed here.

Services means the services available on the Website including facilitating the sale and purchase of products.

We, our and us means Ramsay Health Care Limited and Judevie Pty Ltd and our respective related bodies corporate and any directors, officers employees, agents or other personnel of those entities.

Website means the websites at www.ramsaypharmacy.com.au and at www.ramsaypharmacyonline.com.au.

You and your means the person or customers using the Website.

All information contained on the Website, including information relating to medical and health conditions, products and treatments, is general, non-exhaustive information and does not take into account your specific circumstances. This information is not intended to be medical advice or a substitute for medical advice and should not be used for diagnosing, treating, curing or preventing a health problem or disease. You take full and total responsibility for what you do with this information and for verifying the accuracy of this information, and any resulting outcomes from your actions.

Product information may have been written by the relevant manufacturer, supplier or other third party and such information may not have been verified by us. Product images displayed are for representation purpose only. Actual products may differ from images shown.

While we take all reasonable steps to ensure that the information on the Website is based on current and up-to-date information, we note that some of this information is the subject of ongoing research, clinical experience and differing opinions among authorities.

You may only use this Website for the purposes of accessing and using the Services (for personal use) and for no other purpose. By using this Website, you are agreeing to these terms and conditions. You agree that you will use the Website in accordance with all applicable local, state, national and international laws, rules and regulations.

You agree that you will not use, nor will you allow or authorise any other party to use, the Website for any purpose or in any way that is unlawful, defamatory, harassing, abusive, fraudulent, obscene or inappropriate or in a way which conflicts with the Website or the Services.

  • use data mining, robots, screen scraping or similar data gathering and extraction tools on the Website; or

If you are under 18, you may only register an account and use the Services with the involvement of a parent or guardian.

We hold or have been licenced the copyright to the content of this Website, including all uploaded files, layout design, data, graphics, articles, file content, codes, news, tutorials, videos, text, icons, images, typefaces, video, audio, reviews, forum posts and databases. You must not use or replicate this copyright material other than as permitted by law.  Specifically, no materials or part of any materials from this site may be copied, reproduced, duplicated, modified, republished, uploaded, posted, transmitted, sold, resold, exploited or distributed in any form or by any means unless expressly agreed to by us.

The trade marks and logos contained on this Website are trade marks of Ramsay Pharmacy Health Care Limited and/or its related bodies corporate which are protected by law. Use of these trade marks is strictly prohibited except with our express, written consent.

This Website may contain links that direct you outside of this Website to websites controlled by third parties (“Third Party Websites”).  This may include links that enable you to order a product or use a service through a Third Party Website, such as links that enable you to place orders for pharmacist only and prescription medication through the Ramsay Pharmacy App which is a platform operated by MedAdvisor International Pty Ltd.

These links are provided for your convenience and are not an express or implied indication that we endorse or approve of the Third Party Website, its content or any associated website, product or service.  Where you order a product or use a service that is provided or facilitated by a third party, you will also be bound by the terms and conditions of the third party provider and we recommend that you review those terms and conditions prior to placing an order for a product or using a service.

We are not responsible for any content or information found on any Third Party Website. We accept no liability for loss or damage arising out of or in connection with your use of these sites and you hereby irrevocably waive any claim against us with respect to such sites.

You must not post or publish any links to any part of our Website which suggests any association, approval or endorsement on our part with respect to you, your website or any other third party, unless we have expressly agreed in writing.

8. Limitation of Liability

Nothing in these terms and conditions excludes or limits your statutory rights as a consumer or our liability for:

  • fraud, negligence or wilful or reckless acts or omissions;
  • any breach of the obligations implied or guaranteed by law (including the consumer guarantees under the Australian Consumer Law); or
  • any other liability which cannot be excluded or limited by applicable law.

In performing any obligation under these terms and conditions, the only duty of us or you is to exercise reasonable care and skill unless otherwise expressly stated.

Subject to the above:

  • to the extent permitted by law (including the Australian Consumer Law), we do not make any warranty or representation as to the accuracy, completeness and fitness for purpose of any information or content on the Website. Statements made are by way of general comment only and you need to satisfy yourself as to their accuracy, completeness and fitness for purpose;
  • to the extent permitted by law (including the Australian Consumer Law), we do not make any warranty or representation that the Website will be available at all times, error free or without disruption nor do we make any warranty as to the results that may be obtained from the use of the Website, or use of the information, content, services, or products provided through the Website;
  • it is your responsibility to ensure that the products are sufficient and suitable for your purposes and meet your individual requirements. We do not warrant that the products will meet your individual requirements.  You acknowledge that the products are standard and not made bespoke to fit any particular requirements that you may have; and
  • all products should be used strictly in accordance with any instructions and health warnings, noting that in some instances instructions should not be considered a substitute for professional medical advice or treatment. You should always check product ingredients or materials, particularly where allergies or sensitivities are known. In the event of any adverse reaction, please discontinue use and seek medical assistance.

Subject to the above, we will not be liable to you, and you will not be liable to us, for any punitive, exemplary, special, incidental or consequential loss or damages or the like arising out of or in connection with the Website, the supply of goods or services or these terms and conditions (other than loss of profits).

This clause prevails over any other clause in these terms and conditions.

9. Payment Methods

Most major credit cards including Visa and MasterCard are accepted on the Website. Please be sure to provide your exact billing address and telephone number, being the address and phone number your credit card bank has on file for you. Incorrect information may cause a delay in processing your order. Your credit card will be billed as soon as your order is placed. This is done to protect the security of your credit card details as we do not store your card details.

10. Discount Codes

We may allow you from time to time to use discount codes. If you have a discount or promotional code, your code needs to be entered at the checkout. These terms and conditions apply to all discount or promotional codes where you must redeem a discount or promotional code to obtain the promotional offer and they are in addition to the terms set out in the promotional offer.

Discount and promotional codes are valid for a limited time only and can only be redeemed in accordance with the special terms that apply to them – such as minimum spend requirements, validity periods and brand, product or sale exclusions. Each discount or promotional code can be used only once, only one may be used per order and they may not be used in addition to any other discount or offer, unless otherwise specified. Each discount or promotional code is not transferrable, is not redeemable for cash or credit and may not be resold. If you return items purchased using a discount or promotional code, we will subtract the value of the discount or promotional code from any return credit or refund to which you may be entitled.

Discount and promotional codes must not be published online or disclosed to any third party and you will be liable for any loss occurring as a result of such conduct.

If you violate any of the terms and conditions or misuse any discount or promotional code, the discount or promotional code will be invalid, we may deactivate it and the discount or promotional offer will not apply.

11. Placing an order

In order to place an order for a product on the Website, you must be the purchase price for the product including any goods and services tax and any other applicable charges such as delivery fees. Unless otherwise stated, all charges are in Australian dollars. You must pay for the order in full at the time of the order by one of the accepted payment methods on the Website.

12. Order rejection

In certain circumstances where it is necessary or reasonable to do so, we may need to reject your order after it is placed even if you have already paid and received an order confirmation. This includes circumstances where:

  • a product is not available or is out of stock;
  • there is an error in a product description or the price of a product;
  • supply of the product would be contrary to our professional, legal or ethical obligations or the professional, legal or ethical obligations of any of our personnel;
  • for prescription products, you do not supply a valid prescription, or the prescription is not received by us within the required timeframe;
  • you do not supply additional verifications or information that have been reasonably requested by us;
  • it is appropriate and reasonable for us to limit your purchase quantity in whole or in part (for example, if you are using multiple accounts to exceed purchase quantity limits);
  • we suspect that your order is for commercial or resale purposes;
  • we suspect that your order is fraudulent, or suspect credit card or payment-related fraud; or
  • delivery is not possible to your location.

If we reject an order placed through the Website, then we will endeavor to notify you of that rejection at the time you place the order or within a reasonable time after you submit your order. We will arrange a refund within a reasonable time after we provide that notification to you. Refunds may take several business days to appear on your statement.

13. Product availability

Not all items displayed in our catalogues will be available to purchase on the Website or available from every pharmacy. The products in our catalogues and on the Website are available while stocks last.

14. Monitoring purchases

We may monitor and limit the purchase amounts and/or purchase frequency of products where we consider it appropriate and reasonable to do so.

15. Ownership of products

We will retain the legal ownership of any products purchased by you on the Website until the later of dispatch of the products to you and full payment for the products being received by us. Legal ownership of the products will immediately revert to us if we refund any payment for the products to you.

16. International Orders

[We only ship to Australian addresses and do not accept orders with an international address listed as the delivery address.]

17. Delivery

Delivery Fees

Our delivery service provider is Australia Post.

The following delivery fees apply to all online orders:

  • Free Standard Shipping for orders over $50 (including GST and after any discounts or promotions are applied)
  • AU$8.50 (including GST) for standard shipping for orders under AU$50 (including GST);
  • AU$12.95 (including GST) for Express Post deliveries Australia wide.

Delivery Timeframes

We aim to process orders within two business days of the order being accepted for orders that do not contain prescription products, however factors beyond our control may delay fulfilment. Order fulfilment and delivery times may vary during peak periods. We generally do not process orders on Saturdays, Sundays or public holidays in Australia.

Estimated delivery timeframes for orders that contain prescription products are set out below.

Estimated delivery timeframes after dispatch are available on the Australia Post website. Please note that circumstances beyond our control and beyond the control of our delivery service provider can affect the estimated delivery timeframes, sometimes without notice.

Delivery

You acknowledge and agree that any person at your delivery address who receives your order is authorised by you to receive your order. If no one is available to collect your order at the time that is delivered, written instructions may be left advising you on how you can collect your order or it will otherwise be dealt with in accordance with your authority and instructions as determined by Australia Post.

Once an order has been placed, the delivery option cannot be modified, and your order will be dispatched to the delivery address you provided. As we use a third party delivery provider, delivery of any products ordered by you is subject to their applicable terms and conditions. To the maximum extent permitted by law, we will not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late or delayed delivery or lost packages, although where you notify us that a package has been lost or delayed we will endeavor to resolve the issue with the third party delivery provider on your behalf.

18. Prescription products

When used in these terms and conditions, the term:

  • “prescription product” refers to a prescription animal remedy substance to which the Poisons Standard, schedule 4 (as defined in the Therapeutic Goods Act 1989 (Cth)) applies; and
  • “valid prescription” refers to an original, hardcopy, pen-signed prescription that is compliant with all applicable laws and regulations in respect of the prescription product ordered by you.

Conditions of supply

By placing an order for a prescription product you confirm that the animal specified in your order was examined by a veterinarian and issued a valid prescription.

An order for a prescription product (and any non-prescription products that form part of your order) cannot be processed and dispatched until you provide us with a valid prescription in the name of the animal to be treated.

If a valid prescription is not received within 10 business days of your order date, we are entitled to cancel your order for the prescription product. However, we will use our reasonable endeavours to fulfill your order in respect of any non-prescription products. If your order is cancelled, we will arrange a refund in respect of any products that will not be supplied to you, within a reasonable time after the order is cancelled. Refunds may take several business days to appear on your statement.

If a valid prescription is received more than 10 business days after your order date and your order for the relevant prescription product/s has been cancelled, we will use reasonable endeavours to contact you to confirm whether you would like to place another order. If you do not wish to place another order or we do not receive a response from you within a reasonable time, we will return your prescription to the delivery address stated in your order.

If a valid prescription is received in the required timeframe and your order is processed, we will retain your prescription (including any repeats) unless you contact us and ask us to return it to you.

You agree that any prescription products supplied to you will only be used to treat the animal specified in the prescription and that you will not use the prescription products for any unauthorised or unlawful uses or purposes.

We use a reply paid service that is operated by Australia Post, so you will not need to pay for postage. We recommend that you include a note with your order number in the envelope with your prescription.

To the maximum extent permitted by law, we will not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late or delayed delivery or lost prescriptions (including where we are sending your prescription back to you upon request).

19. Faulty Products & Returns

If you receive a faulty product or a product with a problem, then we will provide you with a refund, replacement, or repair in accordance with this policy and your rights under the Australian Consumer Law. This policy applies for online orders only. If your purchase was made in a pharmacy, it will be subject to the returns policy of that pharmacy.

If we sell you a product with a major problem, you are entitled at law to the choice of a refund or a replacement of the same type of product. Alternatively, you can choose to keep the product and we will compensate you for the drop in value caused by the problem. In some cases, you may also be entitled to compensation for additional damage and loss.

A major problem means the product:

  • is unsafe;
  • is very different from the description or sample;
  • has either one serious problem or several smaller problems that would stop someone from buying the product if they knew about it beforehand; or
  • cannot be used for its normal purpose or another purpose the consumer told the seller about before they bought it, and cannot easily be fixed within a reasonable time.

If we sell you a product with a minor problem, you are entitled at law to ask us to repair or fix the problem or, if a repair is not possible or we cannot do within a reasonable time, you can ask us for a refund or a replacement.

We may require evidence from that the product has a problem and your proof of purchase and we may seek to contact the manufacturer to resolve the issue with the product.

All time limits under the Australian Consumer Law apply to your entitlements in these terms and conditions.

To request a refund or replacement item, email  onlinestore.rpg@ramsayhealth.com.au and provide details of the item, the reason that you are entitled to a refund or replacement and a copy of your proof of purchase.

For faulty items, please contact us within 14 days, and a shipping label will be provided to you if requesting a replacement. All other returns are at the customer’s expense.

Returned items can be sent to Ramsay Pharmacy Shop 6B + 7 Whites Hill Village, 25 Samuel Street Camp Hill QLD 4152 after you have lodged the return.

Refunds will only be issued to your original payment method.

20. Change of mind returns

We do not offer change of mind returns (whether for refund, credit or exchange) or any other returns in any circumstances other than as set out in clause 19.

21. Monitoring and disclosure

We may elect to electronically monitor areas of the Website and may disclose any content, records, or electronic communication of any kind.

  • to satisfy any law, regulation, government request, court order or other legal compulsion;
  • if such disclosure is necessary or appropriate to operate the Website; or
  • to protect our rights or property or the rights of the users of the Website, our representatives, sponsors, third party providers or licensors.

We are not responsible for screening, policing, editing, or monitoring such content.

22. Suspension and termination

We may suspend or deny your access to the Website or any part of the Website at any time if you breach these terms and conditions or if your conduct in association with the Website is fraudulent in breach of any law or regulations or harmful to any other person or to us. In these circumstances, we may also suspend or terminate your registration.

We handle your personal information, including information you have provided to us, or that we have collected and retained relating to your use of the Website and/or our Services, in accordance with our Privacy Policy.  By dealing with us and using the Website and the Services associated with the Website, you acknowledge that existence and application of the Privacy Policy.

Variation

We may amend these terms and conditions, our Privacy Policy and any other terms and conditions or policies relating to this Website from time to time by publishing amended materials online. We may make these changes without notice to you.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Queensland, Australia.  Any disputes concerning this website are to be resolved by the courts having jurisdiction in Queensland.

Waiver

Any failure by a party to enforce one or more of its rights under these terms and conditions will not constitute a waiver of such rights unless such waiver is granted to you in writing.

Rights are cumulative

The rights and remedies provided by these terms and conditions are cumulative and are not exclusive of any rights or remedies provided by law.

Time not of the essence

Time is not of the essence with regard to any of the times, dates and/or periods mentioned within these terms and conditions or any policies or other terms and conditions incorporated by reference.

If a term is unenforceable

If a provision of these terms and conditions would otherwise be illegal, void or unenforceable or impose an obligation or liability that is prohibited by law, the provision is to be read down to the extent necessary to be enforceable or to comply with the law whilst still largely reflecting the intentions of these terms and conditions.

Use of Electronic Addresses

All electronic addresses of us and our directors, officers employees, agents or other personnel published on the Website, in any email or in a newsletter are for business purposes only. The publication of those electronic addresses should not be taken as consent by us or our employees, officers, associates or contractors to receiving unsolicited commercial electronic messages not directly related to the Website.
